Following the enactment of the 1937 constitution, the Treason Act 1939 provided for imposition of the death penalty for treason.[2] The Criminal Justice Act 1990 abolished the death penalty, setting the punishment for treason at life imprisonment, with parole in not less than forty years.[3] No person has been charged under the Treason Act.[citation needed] Irish republican legitimatists who refuse to recognise the legitimacy of the Republic of Ireland have been charged with lesser crimes under the Offences against the State Acts 1939–1998.
